Mediation and Arbitration

Parties can request the General Editor or any National Editor of Forwarderlaw.com to act as mediator or arbitrator according to

  1. Forwarderlaw.com Electronic Mediation
  2. This form of resolution is recommended when the disputed amount is less than $25,000 US dollars, and parties wish a non-binding opinion and recommendation to assist them in the resolution of the dispute.

    The mediation fee (to be paid equally in advance by the parties) is 10% of the amount in dispute, with a minimum fee of $250.

  3. Forwarderlaw.com Summary Arbitration.
  4. Appropriate for larger claims where evidence consists mainly of documents or uncontested facts. The parties are encouraged to state their case with the assistance of a lawyer.

    A retainer must be paid in advance based on the arbitrator's estimate of the time required for the arbitration at $200 per hour to an agreed on maximum.

  5. Forwarderlaw.com Formal Arbitration with hearing.
  6. For larger claims particularly where facts can only be decided after hearing evidence given by witnesses, either orally or by affidavit.

    Fees are based on a per diem of $1500.

    (All fees are in additional to necessary expenses, such as courier services, photocopying, long distance charges etc.)
