Departure and Arrival Times of Goods

BIFA (2005)
Except under special arrangements previously made in writing by an officer of the Company so authorised, the Company accepts no responsibility with regard to any failure to adhere to agreed departure or arrival dates of Goods.

CIFFA Section 5 (a) The Customer must give instructions in writing to the Company a reasonable time before the tender of goods for storage or transport where it requests the Company to:  
(a)arrange for the departure or arrival of goods before specific dates;

Peter Jones' Commentary:

Most Conditions deal with departure and arrival dates under the subject heading of Delay.
Unlike most conditions, the NSAB Conditions squarely deal with the issue of delay. They impose an obligation on a forwarder to arrange for delivery within a reasonable time, which is judged by the information provided by the forwarder in its marketing or at the time of signing the contract. The Conditions go on to allow for a time guarantee, provided it is contained in one of several documents that pass between a forwarder and a customer in connection with a proposed engagement.
