Domicile of Forwarder - Courts of domiile have exclusive jurisdiction over disputes

Domicile
For all disputed claims between the contracting parties, the domicile of the forwarder shall be deemed to be the place of jurisdiction.

In accordance with general principles of Swiss law, the defendant’s domicile is place of jurisdiction. So there might be disagreement whether the place of jurisdiction indicated in art. 33 is exclusive or not, that is, if the forwarder can also claim against the customer at the customer’s domicile.
