Cool Reception for Rotterdam Rules
Only 16 nations have so far signed on to the new Convention, which comes into force 1 year after 20 nations deposit their ratification instruments. The coming out party for the Rules may also turn out to be their farewell; at the very least, the USA has quite a selling job ahead of them!

Legal Issues Arising out of Claims for Delay
Delay claims, which include both claims for economic loss arising from delay as well as claims for spoliation or damage to perishable cargo, are among the most notoriously difficult and complex claims faced by carriage contractors. Nonetheless, neither the common law nor the existing conventions provide a hospitable environment for these claims, accordingly to UK editor Paul Bugden. For more click here:

Calcium Hyperchlorite Back in the News!
Calcium Hyperchlorite can spontaneously self-ignite during carriage, as discussed previously on Forwarderlaw. A recent 89 page decision of the English Courts in the matter of the Aconcagua confirms that shippers tendering this product need an A-1 liability policy with very generous limits! In this case, shippers raised the issue of storage on top of a heated bunker as contributory. For discussion by Peter Jones, click here:
