Boutique Jacob reversed on Appeal – Railway can limit liability
Regular readers may recall prior discussion of the trial decision in the Boutique Jacob case, in which a railway was prevented from enforcing its contractual limits on liability because they had not been signed by the shipper. Although this did not accord with industry practice, it seemed o be required by a Canadian law of specific application to railways. A Multi-modal convention for the Middle East?
Jean-Michel Moriniere, our Forwarderlaw editor for the UAE, writes to advise that a multimodal convention is now open for signing by the 13 members of the UN Economic and Social Commission for Western Asia (ESCWA).
